Papa John's Facing $250 Million Text Message Spam Lawsuit

Pizza chain Papa John's is facing a $250 million class-action lawsuit for allegedly spamming customers with hundreds of thousands of illegal text messages.
The lawsuit, filed in the U.S. District Court in Seattle on Monday, contends that Papa John's violated state and federal law by sending out 500,000 unwanted text messages advertising the chain's products in early 2010. The messages, blasted out to customers through mass texting service OnTime4U, offered deals on Papa John's pizza.
"After I ordered from Papa John's, my telephone started beeping with text messages advertising pizza specials," Erin Chutich, one of the plaintiffs in the case, said in a statement. "Papa John's never asked permission to send me text message advertisements. Hopefully, this will be an important victory for consumers. Our lawsuit is about keeping spam from spreading from our email to our cell phones."
OnTime4U, which sent the messages on behalf of Papa John's franchisees, is also listed as a defendant in the case. There is no evidence that Papa John's contracted directly with OneTime4U, but the suit alleges that the company encouraged its franchisees to use the marketing firm's services.
Franchisees allegedly gave the marketing firm lists of telephone numbers of people who purchased pizza without getting consent from those customers first. OnTime4U then removed landline numbers from the list and blasted the remaining cell phones with text-based advertising.
In April 2010, Papa John's sent a memo to all franchisees and corporate stores noting it had been receiving complaints from customers about the text messages. The memo noted that "sending unsolicited messages to mobile devices is most likely illegal." The company then formally disallowed the practice, directing franchisees to end their business relationship with OnTime4U and have the firm delete any Papa John's customer information from its systems.
The federal Telephone Consumer Protection Act (TCPA) of 1991 bars companies from sending text message advertisements to customers that have not specifically opted into the service. Attorneys representing the plaintiffs said this could be one of the largest damages awards ever recovered under the TCPA. Papa John's customers could be awarded $500 or more in damages for each illegal text message.
For its part, Papa John's said its corporate arm is not subject to the lawsuit because the messages were sent by a third-party vendor and a small number of franchisees, according to a report from CNN Money.
The company also said it plans to appeal the federal judge's decision to certify the case.
"We don't agree with it and will continue to aggressively defend it," said Caroline Oyler, Papa John's head of legal affairs. "We'll continue to litigate the case and defend the lawsuit and move to have it dismissed."

Apple Ordered to Pay $368 Million in Patent Case Brought by VirnetX

Apple declined to comment, but is expected to appeal. A VirnetX representative was not immediately available for comment.
VirnetX also has filed complaints with the U.S. International Trade Commission against Apple, alleging that its iPhone, iPad and Mac products violate the company’s patents. In addition, the company has cases pending against Cisco, Avaya and Siemens, with those cases set for trial in March 2013.
The patent holding company had previously won a lawsuit against Microsoft, alleging several versions of Windows also infringed on its patents.

Apple sells 3 million new iPads over the weekend

Apple has announced that they sold 3 million new fourth generation iPad and iPad Mini in the first weekend of availability. That figure is double the company's previous record of 1.5 million third-generation iPads sold in March.

The company did not differentiate sales between the two tablets, but the rumor is the Mini sold better than its expensive older brother.

"Customers around the world love the new iPad mini and fourth generation iPad," said Tim Cook, Apple's CEO. "We set a new launch weekend record and practically sold out of iPad minis. We're working hard to build more quickly to meet the incredible demand."

Apple sold out of its pre-order iPad Mini units in under a day, with shipping times now over two weeks for delivery. Apple does not count an online sale until it actually ships, meaning the 3 million figure could be a lot higher.

Samsung Galaxy S III smartphone sales pass 30 million

Samsung said Monday that it has sold more than 30 million flagship Galaxy S III smartphones in about five months, making it one of the fastest selling smartphones in the world.
Samsung, the world's biggest mobile phone maker, launched the smartphone at the end of May, months before competitors began shipping the latest versions of their top phones.
When Apple unveiled the iPhone 5 in September, Samsung launched an advertising campaign poking fun at the new iPhone.
The South Korean firm said the Galaxy S III is selling at a much faster rate than its predecessor announced a year ago, the Galaxy S II. The Galaxy S II took 14 months to hit 30 million sales. Sales of the Galaxy Note II, which fills a market niche between smartphones and tablets, surpassed 3 million in 37 days, Samsung said last week.
The runaway demand for high-end smartphones fueled record profits at Samsung in recent quarters while other consumer electronics firms were hit by the global economic downturn that dented demand for TVs and personal computers.
Samsung, which also makes TVs, home appliances, semiconductors and display panels, got almost 70 percent of its third-quarter operating profit from the division that makes mobile devices, cameras and computers.
Nomura Financial Investment in Seoul forecasts that Samsung will sell 67 million smartphones in the October-December quarter. That would be about 10 million units more than Samsung's smartphone sales in the previous quarter.
Samsung does not disclose its quarterly smartphone sales figures, but analysts and research firms say the company sold a record 56-58 million smartphones in July-September.

Nomura, which is more optimistic about Samsung's prospects than other forecasters, says Samsung's mobile communications business will post 5 percent growth in fourth quarter profit from the third quarter, thanks to the high-end phones

Samsung sells 3 million Galaxy Note II

Samsung has announced this week that it has sold 3 million Galaxy Note 2 in just 30 days.For comparison, the original oversized phone sold 1 million units in its first month of availability and hit 3 million after 90 days.

Furthermore, the company said it reached 30 million Galaxy S III smartphone sales, an impressive record.

More impressively for Samsung is the fact that the Galaxy Note II only just reached the American market, meaning all three million sales were from overseas.

The note has a massive 5.5-inch screen, a new 16:9 aspect ratio with 1280x720, Android 4.1 Jelly Bean, a quad-core 1.6GHz processor and 2GB RAM.
